How we collect, use and protect personal information — and what you can ask us to do with it — under the Protection of Personal Information Act 4 of 2013.
In-Detail Advertising CC (“IN·DETAIL”, “we”, “us”, “our”) is a design and marketing agency established in 1991 and operating from Bedfordview, Johannesburg. For the purposes of the Protection of Personal Information Act 4 of 2013 (“POPIA”), we are the responsible party for the personal information described in this policy.
Information Officer. Our Information Officer, appointed and registered with the Information Regulator as required by POPIA, is Gerald Yapp. All privacy queries, access requests and objections should be directed to hello@in-detail.com, marked for the attention of the Information Officer.
This policy explains what personal information we collect, why we collect it, how we use and protect it, who we share it with, and what rights you have under POPIA. It applies to visitors to in-detail.com, to prospective and existing clients, to suppliers and contractors, and to people who apply to work with us.
It does not apply to third-party websites we link to. Those sites have their own privacy practices and we are not responsible for them.
When you complete the enquiry form on our contact page, we collect your name, email address, telephone number (including country code), the service you are interested in, and the content of your message. When you contact us by email, telephone or WhatsApp, we receive whatever information you choose to share in that conversation.
When you visit the website we automatically collect limited technical information through Google Analytics, including your approximate location (usually city level), device and browser type, pages viewed, referring website, and time spent on the site. This is collected through cookies and similar technologies — see section 6.
In the course of providing services we process business contact details, billing and banking information necessary to invoice and be paid, project correspondence, and any material you supply to us for use in the work.
We do not intentionally collect special personal information as defined in section 26 of POPIA — such as information about your health, race, religious or political beliefs, biometric data or criminal history — and we ask that you do not send it to us unless it is genuinely necessary for the work and we have agreed how it will be handled.
POPIA requires that processing be justified. We rely on the following grounds set out in section 11 of the Act:
We do not sell your personal information. We share it only where necessary, and with parties who are bound to protect it. Under POPIA these are our operators, and we require each of them by written agreement to process information only on our instruction and to maintain appropriate security (sections 20 and 21 of the Act).
Where a project requires us to share your information with a subcontractor — a photographer, developer or printer, for example — we will tell you and will bind that party to equivalent obligations.
Cookies are small files placed on your device. We use them for two purposes: to make the site work as intended, and to measure how it is used.
You can block or delete cookies through your browser settings, and you can opt out of Google Analytics entirely using Google’s browser add-on. Blocking analytics cookies will not affect your ability to use the site.
Some of the services we rely on — notably Google Analytics and WhatsApp — process information on servers outside South Africa. Section 72 of POPIA permits this where the recipient is subject to a law, binding agreement or corporate rules that provide an adequate level of protection comparable to POPIA, or where you have consented, or where the transfer is necessary to perform a contract with you. We rely on the contractual protections offered by these providers and on the grounds set out in section 72.
Section 14 of POPIA requires that we not keep personal information longer than necessary. In practice:
Where we are required by law to keep information for longer, we will do so and no longer.
Section 69 of POPIA restricts unsolicited electronic marketing. We will only send you marketing by email or message if you have asked us to, or if you are an existing client and the message concerns services similar to those we have already provided. Every marketing message we send includes a way to unsubscribe, and you can also opt out at any time by emailing hello@in-detail.com. Opting out of marketing does not stop necessary communications about work in progress.
Section 19 of POPIA requires appropriate, reasonable technical and organisational measures. Ours include encryption of the website in transit (HTTPS across the whole site), access controls and individual credentials for administrative systems, restricting access to personal information to staff who need it for their work, and agreements with our operators requiring equivalent standards.
No system is perfectly secure. If a security compromise occurs in which your personal information has been accessed or acquired by an unauthorised person, we will notify you and the Information Regulator as required by section 22 of POPIA.
Under POPIA you have the right to:
To exercise any of these rights, email hello@in-detail.com for the attention of the Information Officer. We may ask you to verify your identity before we act, so that we do not disclose your information to someone else. We will respond as soon as reasonably possible. A request for access to a record is dealt with under PAIA and a prescribed fee may apply.
Our services are directed at businesses, and we do not knowingly collect the personal information of children under 18 without the consent of a competent person, as required by sections 34 and 35 of POPIA. If you believe we hold a child’s information without that consent, contact us and we will delete it.
If you are not satisfied with how we have handled your personal information or your request, please raise it with us first — most issues are resolved quickly. You also have the right to complain directly to the Information Regulator of South Africa:
Our manual prepared in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 is available on request from hello@in-detail.com.
We may update this policy as our practices or the law change. The date at the top of this page shows when it was last revised. Material changes will be brought to the attention of clients directly.
